About us

By The Cap is a trading name of The LOTD Group Limited (company number 17039627), a company registered in England and Wales. Our registered office is 66 Paul Street, London, England, EC2A 4NA. Please note: our registered office is not a returns address. Any parcels sent to this address will be rejected. Returns instructions are provided upon a confirmed returns request. Eligibility

To place an order with us you must be at least 18 years old and resident in the United Kingdom. By placing an order you confirm that you meet these requirements.

Orders

When you place an order, you are making an offer to purchase the items in your order at the prices stated. We will send you an order confirmation by email, but this does not constitute acceptance of your order.

A contract between you and us is formed when we confirm that your order has been dispatched. We reserve the right to decline any order at our discretion, including where items are out of stock, where payment cannot be authorised, or where we suspect fraudulent activity.

All orders are subject to availability. We sell in limited seasonal drops and do not guarantee ongoing availability of any item.

Pricing

All prices are displayed in pounds sterling and are inclusive of any applicable taxes. Delivery charges are shown separately at checkout. We reserve the right to amend prices at any time. The price applicable to your order will be the price displayed at the time your order is placed. In the event of a pricing error, we will notify you as soon as possible and give you the option to proceed at the correct price or cancel your order for a full refund.

Payment

Payment is taken at the time of order. We accept the payment methods displayed at checkout. All transactions are processed securely. We do not store your payment card details.

Delivery

We deliver within the United Kingdom using DPD. Estimated delivery timeframes are shown on our shipping page. These are estimates and not guarantees. We will do our best to meet delivery estimates but are not liable for delays caused by circumstances outside our control, including courier delays, adverse weather, or other events beyond our reasonable control. If your parcel appears to be lost, please contact us at concierge@bythecap.com and we will liaise with DPD on your behalf to find a resolution. Please report non-delivery within 14 days of your expected delivery date so that we are able to pursue a claim with our courier.

Returns

Please refer to our returns policy for full details of how to return an item, eligibility conditions, and our returns and restocking fee. Our returns policy forms part of these terms and conditions.

Cancellations

Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your items without giving a reason. To exercise this right, please contact us at concierge@bythecap.com within 14 days of delivery.

Faulty or incorrect items

If you receive a faulty or incorrect item, please contact us at concierge@bythecap.com within 90 days of delivery with your order number and photos. We will resolve the issue promptly. Your statutory rights are not affected.

Intellectual property

All content on the By The Cap website, including text, images, graphics, and brand assets, is owned by or licensed to The LOTD Group Limited. You may not reproduce, distribute or use any content from this website without our prior written consent.

Limitation of liability

We accept liability for death or personal injury caused by our negligence, and for fraudulent misrepresentation. Nothing in these terms is intended to limit or exclude liability where it would be unlawful to do so. To the fullest extent permitted by law, we are not liable for any indirect or consequential losses arising from your use of our website or the purchase of our products, including loss of profit, loss of data, or loss of opportunity. Our total liability to you in connection with any order will not exceed the value of that order.

Your statutory rights

Nothing in these terms and conditions affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

Privacy

Your use of our website and the personal data you provide when placing an order or signing up to our waitlist is governed by our privacy policy, which is available on our website.

Changes to these terms

We may update these terms and conditions from time to time. Any changes will be posted on this page with an updated date. Changes will not affect any orders already placed.

Governing law

These terms and conditions are governed by the laws of England and Wales. Any disputes arising from these terms or your use of our website will be subject to the exclusive jurisdiction of the courts of England and Wales.
